Order & AdministrationsQ 01: How can I order a search or watch?A : Very easily. You can download an order form for all of our products. In that way, you will always be sure of the most recent version. You can complete it and send it back by email, fax or post to the Thomson Brandy office in Japan. Of course, you can also order urgent searches by telephone. Q 02: When can I stop or start watches?A : Watches can be started and stopped whenever you want. It is best to first contact our Customer Support for large trademark portfolios. Q 03: What is the deadline for ordering a standard or express search?A : You can order these searches throughout the day until 17:30 Japan time. Orders received after 17:30 are considered orders for the next working day. The deadlines for execution begin on the first working day after receipt of the order. They end when the reports are shipped. Q 04: What is the normal delivery method for search reports?A : Depending on the product you require, the standard delivery method is by email or courier. Q 05: Do I have to pay for the courier or fax costs for delivering the searches?A : Additional costs are only charged if the delivery by courier or fax is not the standard method. Electronic delivery is always free of charge. Q 06: How should I pay for searches?A : All invoices are sent at the same time or after the search reports, unless they were sent by e-mail only. However, searches on SAEGIS are invoiced monthly. The amount should be paid within 30 days following the end of the month in which the invoice was issued. Q 07: How should I pay for watches?A : Watches are invoiced at the beginning of the watch period. The invoice is valid for 12 months. The amount should be paid within 30 days following the end of the month in which the invoice was issued. Q 08: What should I do with a combined mark (in which there is both a word and image element)?A : The mutual importance of the separate elements plays a crucial role in this. Do you not want to see only device marks but also similar or identical word marks? Then we recommend searching or watching both word and device. However, is it sufficient, for example, only to see logos when these are registered in combination with an identical or similar word? In that case, a word search or -watch would be adequate. Search CoverageQ 01: Is a search of Community trademarks sufficient to find out whether a mark is still free within the European Union?A : No, even though the Community trademarks are protected throughout the European Union, there are also national registrations that were not registered as Community trademarks. We created our EU-packages to search these marks in one go. Q 02: Is my trademark ready for the expansion of the European Union?A : From 1 May 2004 the European Union will gain an additional 10 member states. We have, therefore, adjusted our search- and watch packages accordingly. The EU-packages were expanded and New EU-member state Packages have been created. Q 03: What countries are included in the worldwide watching?A : Our worldwide watching covers more than 220 countries / regions and orders can be placed by regions and by individual countries as well. Please ask our Customer Support for the list of countries we cover. Q 04: Status watching is offered for which countries?A : Status watching informs you of a change in the status of your mark. We offer this watching in approximately 15 countries. Q 05: For which countries is it possible to obtain information concerning the national publication of international trademarks?A : In some countries the opposition period for international trademarks only begins after publication in the national trademark journal. You may be kept informed of these publications for a number of countries on request. Q 06: What countries constitute part of a worldwide (WISS) and regional (RISS) Identical Screening Search?A : Our ISS databases has more than 220 countries / regions and orders can be placed by regions and by individual countries as well. Please ask our Customer Support for the list of countries we cover. How Identical Screening Search (ISS) different from other searchesQ 01: Is an Identical Screening Search (ISS) into a device mark possible?A :No. An ISS into device marks is not yet possible. However, an ISS into word marks may be complemented with the logos of marks found with a device element. Q 02: What is the difference between an owner search and an Identical screening search (ISS) by applicant?A : An owner search reports all marks in the name of a specific owner. Moreover, you will receive a status report of all trademarks found. An ISS by applicant name reports all first publications of the marks registered by a specific owner since 1976. The list of marks found indicates the situation at the time of first publication. If you also require a current status of a mark, you can request a status report. Q 03: What is the difference between an Identical Screening Search (ISS) and an identical search?A : Our analysts report identical and phonetically identical marks in both types of searches. An identical screening search covers all marks published for the first time since 1976. The list of marks found indicates the situation at the time of first publication. Of you also require a current status of a mark; you can request a status report. An identical search covers all active marks and unpublished filings (for most countries). We automatically add a status report with all marks selected. Q 04: Can I base my decision whether or not to register a trademark on an Identical Screening Search (ISS)?A : No. An identical screening search is a screening tool and only gives a picture of identical marks since 1976. We recommend a full availability search to find out the availability of your mark. OthersQ 01: Can foreign characters (Greek, Chinese, etc.) be watched or searched?A : A watch or search of Japanese and Chinese characters is possible. Although watch or search of foreign characters is not possible, it is possible to have their transliterations watched or searched. Q 02: Why must I sometimes submit the goods and services if I already have the classes?A : Not all countries follow the international classification of Nice. This additional information is consequently essential for those countries. A Common Law search also requires a list of goods. (also refer to "What is Common Law?"). Q 03: When is it best to search the International Register and the Community Trademarks?A :If the country you want to search is a member of the Madrid Agreement or Protocol and/or is a member state of the European Union, you should certainly not ignore the International Register and the Register of Community Trademarks. Only then will the report include all marks valid in that country. Q 04: Does Brandy offer search packages?A : Yes. A number of countries form a region of economic or political importance. We created search packages for this, which are naturally cheaper than the sum of the individual countries. Q 05: What is the difference between an identical Search and a full availability search?A : Our analysts look for identical and phonetically identical marks in an identical search. You can use it to locate the existence of a specific mark. If you want to file a proposed name as a trademark, we recommend a full availability search. Here our analysts now only search for identical and phonetically identical marks but also for similar marks. The similarity may be visual, auditory or conceptual. Q 06: What is the difference between a reproduction and a status report?A : A reproduction is a copy of a mark as published in the official trademark journal. A status report goes further. It gives the current status of a mark; the current owner and the classes and goods list in addition to a copy of the mark as published at the time in the official trademark journal. Q 07: What is the difference between an in use search and a pharma in use-similarity search?A :An in use search checks the use of a particular registered trademark. This search is carried out by a specialized company. They collect and compare information from various sources such as trade journals, distributors, consumer associations and all manner of databases.
